Driver Posting in the EU: Obligations of Transport Companies from the Region
Transport companies from Serbia, Bosnia and Herzegovina, Montenegro, and North Macedonia that perform international transport operations within the territory of the European Union are subject to increasingly strict rules regarding the posting of drivers. These obligations arise from the EU Mobility Package and the national laws of EU Member States and relate to administrative notifications that the employer must submit before a driver begins working in a specific country. This obligation applies if you send a driver to work in France, Germany, Austria, Belgium, Poland, Latvia, or Slovenia.
What does the new Zoll portal for driver notifications in Germany bring?
One of the developments expected for transport companies this year is the introduction of a new portal of the German Customs Authority (Zoll), through which notifications under the German Minimum Wage Act (MiLoG) will be submitted. This portal primarily changes the technical method of submitting notifications, but also the level of data that must be provided to German control authorities.
The new system is expected to enable more precise recording of drivers’ work performed in Germany, including clearer definition of the operational plan (Einsatzplanung), that is, the working period, planned driver assignments, and data on transport clients.
In practice, this means that notifications will have to be more precisely linked to actual transport operations. During inspections, the German Customs Authority already compares the data from submitted notifications with transport documentation, CMR documents, and data from digital tachographs. With the introduction of the new portal, further improvements to these control mechanisms are expected, as part of the broader process of digitalizing transport supervision in the EU.
According to currently available information, the new portal of the German Customs Authority is expected to become operational on 29 June 2026. Note: Driver notification in Austria is not required for transport companies registered in countries outside the European Union. However, the driver must carry an employer’s certificate called a “Mitarbeiterpass,” which must contain legally prescribed information about the driver’s employment status and remuneration.
