Belgium as an EU control point: what transport companies need to know?

Belgium, as one of the Member States of the European Union, consistently enforces the rules on the posting of drivers. Therefore, it is not surprising that transport operators carrying out transport operations on its territory are frequently subject to inspections.

If your company operates transport services in Belgium, it is important to understand when the obligation to submit a posting declaration arises and which administrative requirements must be fulfilled in order to avoid high penalties. Non-compliance with these rules can lead to serious financial consequences, but with timely preparation and proper administration, the risks can be effectively controlled.

When is it mandatory to declare the posting of drivers in Belgium?

According to the applicable regulations, transport companies registered in non-EU countries such as Serbia, Bosnia and Herzegovina, Montenegro, and North Macedonia are required to report every posting of drivers to Belgium to the Federal Public Service Employment, Labour and Social Dialogue (Service public fédéral Emploi, Travail et Concertation sociale). Transit operations and bilateral transport are exempt from this obligation.

To submit a driver posting declaration in Belgium, a national reporting system is used, and the procedure includes submitting the declaration online before the start of the transport operation. After submission, the competent authority issues a confirmation which the driver must carry during their stay in Belgium. In addition, the carrier is required to provide all necessary documentation confirming the nature of the transport in order to demonstrate that the operation is permitted.

The obligation to declare the posting of drivers in Belgium also applies to transport companies registered within the EU. This obligation arises from EU regulations on the posting of drivers in road transport, and the declaration must be submitted before the start of the activity via the IMI system.

Which working conditions apply in Belgium?

When a driver is considered posted to the territory of Belgium, the applicable national regulations must be observed, including minimum wage requirements in line with Belgian collective agreements for the transport sector. It should be noted that the minimum hourly wage for professional drivers in 2026 ranges from €14.93 to €15.81 per hour, depending on the driver category.

How to overcome administrative challenges in transport operations in Belgium?

Given that inspections across the EU are becoming increasingly digital and comprehensive, there is no longer any room for improvisation. Penalties for non-compliance with driver posting regulations are cumulative, meaning they are multiplied by the number of workers involved in the violation. As a result, a single inspection can cost a company tens of thousands of euros.

For breaches of posting regulations, the following penalties apply:

For the transport company: from €6,000 to €24,000 (failure to submit a declaration, incorrect data, non-payment of minimum wage),
For the driver: from €600 to €2,400 (if the driver does not carry the required documentation, such as the posting declaration or proof of transport, in the vehicle).

It is important to emphasize that the control mechanisms of Belgian authorities are not limited to roadside inspections. Competent authorities also conduct subsequent administrative checks, requesting complete documentation on drivers’ working conditions and wages, even up to three years after the transport operation has been completed.
